About these terms
These Terms of Service ("Terms") are an agreement between you and Svelty (also known as Svelty Creative Works), a marketing agency based in Hyderabad, Telangana, India ("Svelty", "we", "us"). By using svelty.in, asking us for an audit or quote, booking SveltyShots or hiring us, you agree to these Terms.
When you hire us, we'll also agree a written proposal, quote, statement of work or contract (a "Proposal") covering the specific services, deliverables, fees and timelines. The Proposal and these Terms together make up our agreement. If they conflict, the Proposal applies.
If you accept these Terms on behalf of a business, you confirm you're authorised to do so, and "you" includes that business.
Using this website
- You may browse svelty.in and share links to it. Please don't copy, scrape or reuse its design, text, images or videos without our written permission.
- Don't misuse the site or its forms: no spam, false information, attempts to break or overload it, or sending us anything unlawful or harmful.
- Case studies, client stories and figures on this site describe past work. They show what's possible, not a promise of the same results for you.
- We keep the site accurate and available, but we provide it "as is" and may change or pause it at any time.
- Links to Instagram, WhatsApp and other sites go to services we don't control, and their own terms apply.
Our Privacy Policy explains how we handle the details you send us.
Audits, quotes and proposals
- Our free brand audit is free with no obligation. It's our honest view based on what's publicly visible plus anything you share, and it's meant as guidance, not a guarantee.
- Quotes and Proposals are valid for 30 days unless they say otherwise, and depend on the information you've given us being accurate.
- Work starts once you've accepted the Proposal in writing (email or WhatsApp is fine) and paid any advance it asks for.
Our services
Depending on your Proposal, our services may include social media management, content and reel creation, shoot production, Meta and Google advertising, branding, websites and landing pages, custom CRM, and AI agents and automations.
- Scope. We deliver what the Proposal lists. Extra work, such as additional reels, shoots, revisions beyond those included, or new platforms, is quoted separately before we start it.
- Revisions. Each deliverable includes the number of revision rounds stated in the Proposal. Changes to an approved brief may count as new work.
- Timelines. We'll agree a schedule with you. Dates depend on you sending content, access, feedback and approvals on time.
- Our team. We may use trusted freelancers or partners, such as editors, photographers or developers. We remain responsible for their work and they are bound by the same confidentiality.
Fees and payment
- Fees, payment schedules and any advance are set out in your Proposal. Unless it says otherwise, monthly retainers are invoiced at the start of each month and project fees are invoiced as agreed milestones.
- Prices are in Indian Rupees and exclude GST and other applicable taxes, which are added to invoices.
- Invoices are due within the period stated on them, or 15 days if none is stated.
- Ad spend is separate from our fees. It's paid by you directly to Meta, Google or other platforms, or billed to you at cost if we agree to pay it on your behalf.
- Travel, props, location fees, stock media, software subscriptions and other third-party costs are charged as agreed in advance.
- If a payment is overdue, we may pause work and scheduled posts or campaigns after letting you know, and restart once it's settled.
- Fees already paid for work carried out are non-refundable, except where your Proposal or the law says otherwise.
What we need from you
- Accurate information about your business, offers, pricing and audience.
- Timely access to the accounts, pages, website and tools we need, and timely feedback and approvals. If a deliverable isn't approved within 5 working days, the schedule may move.
- Permission to use everything you give us, such as logos, photos, videos, music, testimonials and customer details, and consent from anyone who appears in shoots you arrange.
- Responsibility for the claims your business makes. You're responsible for the accuracy and legality of your products, prices and offers, including any regulatory requirements that apply to you, such as RERA registration for real-estate projects and the ASCI advertising code. We'll flag concerns we notice, but the final approval is yours.
- Responsibility for how you use the leads, customer data and tools we set up for you, including following data protection law when you contact those leads.
Ads and third-party platforms
- Our work runs on platforms we don't control, including Instagram, Facebook, WhatsApp, Google and YouTube. Their rules, algorithms, ad approvals, pricing and outages can change without notice. We aren't responsible for platform decisions such as rejected ads, reduced reach or suspended accounts, but we'll help you respond to them.
- Your accounts stay yours. Ad accounts, business managers, pages, domains and analytics should be owned by you, with us added as a partner or user. Where we create an account for you, we'll transfer ownership to you on request and when the engagement ends.
- No guaranteed results. We plan carefully and report honestly, but followers, reach, leads, sales and return on ad spend depend on many factors outside our control, so we can't guarantee specific numbers unless a Proposal expressly says so.
- Music, templates, fonts and stock media are used under their providers' licences. Audio from Instagram's music library, for example, can only be used on Instagram.
Who owns the work
- Your materials stay yours. Anything you give us remains your property, and you give us permission to use it to deliver our services.
- Deliverables become yours on payment. Once you've paid for them in full, you own the final content we create for you: reels, posts, designs, ad creative, raw footage, brand assets and website content. Until then, we hold the rights.
- What we keep. We keep ownership of our own tools, code libraries, templates, processes and know-how, and of concepts you didn't choose. Where these form part of something we deliver, such as a website or CRM, you get a permanent licence to use them for your business.
- Our portfolio. We may show published work we made for you in our portfolio, on svelty.in and on our social channels, unless you ask us not to in writing. We'll never share confidential information this way.
SveltyShots bookings
- Bookings are made on WhatsApp. A booking is confirmed when we confirm the reel-maker, date and time in writing, and you've paid any advance in your quote.
- Pricing depends on the occasion, duration and location, and is shared in your quote. Cancellation, rescheduling and refund terms are included in your quote and confirmed before you book.
- You're responsible for permission to film at the venue, and for letting guests know they may be filmed. Tell us about anyone who doesn't want to appear.
- Reels are edited and sent during or soon after the event as agreed. Delivery times can be affected by venue conditions, connectivity or event timings outside our control.
- We may share reels from your event in our portfolio and on our social channels unless you tell us not to before the event.
Confidentiality
We keep your non-public business information confidential, such as sales numbers, strategy, unreleased launches, logins and customer data. We use it only to deliver our services and share it only with team members and partners who need it, under the same duty. This doesn't cover information that is already public or that we must disclose by law. We ask you to treat our pricing, proposals and methods the same way.
Ending an engagement
- Retainers have a minimum term of three months, because social and paid media need at least a quarter to work. After that, they continue month to month until either of us gives 30 days' written notice.
- Projects end when the agreed deliverables are complete and paid for.
- Either of us may end the agreement straight away by written notice if the other seriously breaches it and doesn't fix the problem within 15 days of being told.
- When an engagement ends, you pay for work done and costs incurred up to the end date. We hand over paid-for deliverables and files, transfer any accounts we created for you, and remove our access to yours.
Liability
- We'll provide our services with reasonable skill and care. Apart from that and anything the law doesn't allow us to exclude, we don't give other promises or warranties.
- We aren't liable for indirect or consequential losses, such as lost profits, revenue, data or opportunities, or for problems caused by platforms, third-party services, or materials and information you provided.
- Our total liability under any engagement is limited to the fees you paid us for the three months before the event that caused the claim.
- You agree to cover us against claims arising from content, materials or claims you supplied or approved, or from your use of the leads and data we delivered.
- Neither of us is responsible for delays caused by events beyond reasonable control, such as natural disasters, platform outages, government action or serious illness.
Governing law and changes
These Terms are governed by the laws of India. If a dispute arises, we'll first try to resolve it by talking. If that doesn't work, the courts at Hyderabad, Telangana have exclusive jurisdiction.
We may update these Terms from time to time. The version on this page applies from the date shown at the top. Changes don't affect a Proposal you've already accepted unless we both agree. If any part of these Terms can't be enforced, the rest still applies.
